HCEG Website Terms and Conditions of Use
All access to and use of the world wide web pages of the HCEG website (the "HCEG Website") is subject to the following Terms and Conditions. Entry to and any use of the HCEG Website constitutes your agreement to abide by these Terms and Conditions as amended from time to time. Please read them carefully. You may print a copy of these Terms and Conditions for your records by clicking on the printer icon on your browser. If you do not agree to all of these Terms and Conditions, please leave the HCEG Website immediately.
1. Parties
These Terms and Conditions, and your acceptance of them, form a contract between you ("You") and The Honourable Company of Edinburgh Golfers, a club having its premises at Muirfield, Gullane, East Lothian EH31 2EG, Scotland, UK ("HCEG"). However, in accordance with the rules of the Club, the management and administration of the Club is in the hands of The Honourable Company of Edinburgh Golfers (Management) Limited (the "Management"), a company limited by guarantee, and the Management is entitled to act on behalf of HCEG in respect of any enforcement of, or any other action relating to, these Terms and Conditons.
2. Copyright

The copyright in any material on the HCEG Website is owned by HCEG or used by HCEG under licence and is protected by the copyright laws of the United Kingdom, international copyright treaties and all other applicable copyright and intellectual property laws. You are entitled to copy any information for your own personal use but may not remove any product identification, copyright notices or legends or other notices or proprietary restrictions from any of the material or information contained on the HCEG Website, except with the prior written consent of HCEG. Any unauthorised use, downloading, retransmission, or other copying or modification of any of the content of the HCEG Website may be in breach of statutory or common law rights which could be the subject of legal action. All rights not expressly granted are reserved by HCEG and HCEG's licensors.
3. Trade Marks
MUIRFIELD (word), the MUIRFIELD 1744 and golfer logo, the MUIRFIELD golfer logo, The Honourable Company of Edinburgh Golfers (words) and the HCEG stylised logo are all trade marks of HCEG which may or may not be registered in the jurisdiction from which you are accessing the HCEG Website. In addition, certain names, words, titles, phrases, logos, icons, graphics or designs to the pages of the HCEG Website may constitute trade names or unregistered trade marks of HCEG. The display of any of the above trade names or trade marks on the HCEG Website does not imply that any licence or right has been granted to any third party in respect of the same. All other product or company names and devices, logos, icons, graphics or designs referred to on the HCEG Website are or may be trade marks of their respective owners and are exhibited only in such a manner as is intended to be for the benefit of such trade mark owners and HCEG intends no infringement of such trade marks. The appearance or absence of products, services, companies, or organisations, or advertising of third parties on the HCEG Website does not imply any endorsement or non-endorsement thereof by HCEG. All rights not expressly granted herein are reserved by HCEG and HCEG's licensors.
4. Content (No Warranty)
The information, materials and functions contained in the HCEG Website including text, graphics, links or other items are provided on an "as is" basis. To the fullest extent permitted by applicable law, HCEG disclaims all warranties, representations and undertakings whatsoever, express or implied, specifically including but not limited to warranties of satisfactory quality, fitness for a particular purpose, freedom from computer viruses and non-infringement of third parties' rights. HCEG reserves the right at any time and without notice to change, amend or otherwise vary these Terms and Conditions and the HCEG Website or any part thereof.
5. Data Protection
All personal data collected by HCEG from the HCEG Website shall be held by HCEG on a secure server. You can obtain information on what data is held about You by contacting HCEG at the address below. For certain purposes You may be asked to provide additional consent before HCEG can process your personal data.
The HCEG Website does not make use of cookies.
6. Liability
HCEG and/or the Management shall not be liable for any direct or indirect, special, incidental or consequential loss or damage whatsoever or for loss of profits, business, contracts, data, goodwill, work stoppage or computer failure resulting from the use of or inability to use, interruption or availability of the HCEG Website, its operation or transmission, computer viruses or otherwise in respect of the use of the HCEG Website and howsoever caused even if HCEG and/or the Management has been advised of the possibility of such damages. Each of HCEG and the Management excludes any liability for any errors or omissions from information, materials and functions included in the HCEG Website except to the extent that such liability may not be lawfully excluded under the applicable law. To the fullest extent permitted by applicable law each of HCEG and the Management disclaims all such liability arising from its or its employees', agents or subcontractors' negligence.
Neither HCEG nor the Management is responsible for, nor shall either of them be liable for, the contents of other websites or home pages which are linked to the HCEG Website. Neither HCEG nor the Management shall have any liability in respect of material hyperlinked to the HCEG Website which may be misleading, inaccurate, defamatory, threatening or obscene or otherwise not in accordance with such regulations as may be from time to time in force. The provision on the HCEG Website of a link to another website does not constitute any authorisation by HCEG or the Management to You to access materials held at that location, nor is it evidence of any endorsement or non-endorsement by HCEG or the Management of the material held there. You may not frame, page-jack or link to the HCEG Website without the prior written permission of HCEG. You are not permitted to use any robot, spider, other automatic device or manual process to monitor or copy the HCEG Website or its content without the prior written permission of HCEG.
HCEG operates the HCEG Website from Scotland and makes no representation that the information contained on the HCEG Website is appropriate or available for use in other locations outside the United Kingdom.
7. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland. You agree to submit to the exclusive jurisdiction of the Scottish Courts. You are responsible for compliance with any applicable laws of the country from which you are accessing the HCEG Website.
